No. The copyright symbol doesn't have to be there for there to be a copyright. There is such thing as implied copyright.

It doesn't matter in this case, though. That emoticon is as old as the WWW, all he did was change text on it, just as it was changed for Cataclyzm's. I guess he's just as guilty of infringement. :roll:

Has NC commented on the copyright issue? If so, that is the most blatantly hypocritical thing for him to ever do. I'm sure some of you remember the hassle we went through over Xikron's Godz image that he used illegally.

I guess this "xposing" and copyright infringement is fine when NC and Hitman do it. They're the good guys, they're allowed.

I was just about to make a comment about that. After a certain date any creative works are automatically copyrighted. In the case of an emoticon like that however, I believe it is in the public domain. And yes, if NC is actually supporting this copyright infringement BS he is a bigger hypocrite than Hitman. Of course NC was actually guilty of copyright infringement whereas Cata isn't. In fact if Cata were guily of infringement than so too would Hitman be. The fact of the matter is, the emoticon is in the public domain, and even if it wasn't, Cata's is different from Hitman's so therefore no kind of infringement has occurred. Way to go Hitman you fail at life once more.
