I agree with this because it is his choice to release his creation. Even if you used a SDK to make maps and mods or if you made it from scratch in friggin Notepad, it's still your creation and the copyrights still belong to the original owner.

There is a difference between the creation being releaed and the creation's source being released.
Would you expect video game developers to release their souce for all their games, even though they want you to see the game? No, of course not, it works the same way for this.
